PRIVACY POLICY


Introduction

With the following privacy policy, we would like to inform you about what types of your personal data (hereinafter also referred to as "data") we process, for what purposes and to what extent. The privacy policy applies to all processing of personal data carried out by us, both in the context of the provision of our services and in particular on our websites, mobile, as well as within external online presences, such as our social media profiles (hereinafter collectively referred to as "website").

Definitions

This privacy policy uses the terminology of the General Data Protection Regulation (GDPR).

"Personal data" means any information relating to an identified or identifiable natural person (hereinafter "data subject"); an identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person.

"Processing" means any operation or set of operations which is performed on personal data or on sets of personal data, whether or not by automated means, such as collection, recording, organization, structuring, storage, adaptation or alteration, retrieval, consultation, use, disclosure by transmission, dissemination or otherwise making available, alignment or combination, restriction, erasure or destruction.

"Restriction of processing" is the marking of stored personal data with the aim of restricting its future processing.

"Profiling" means any form of automated processing of personal data consisting of the use of personal data to evaluate certain personal aspects relating to a natural person, in particular to analyze or predict aspects concerning that natural person's performance at work, economic situation, health, personal preferences, interests, reliability, behavior, location or movements.

"Pseudonymization " means the processing of personal data in such a manner that the personal data can no longer be attributed to a specific data subject without the use of additional information, provided that such additional information is kept separately and is subject to technical and organizational measures to ensure that the personal data are not attributed to an identified or identifiable natural person.

"File system" means any structured collection of personal data that is accessible according to specific criteria, regardless of whether this collection is managed centrally, decentrally or according to functional or geographical aspects;

"Controller" means the natural or legal person, public authority, agency or other body which, alone or jointly with others, determines the purposes and means of the processing of personal data; where the purposes and means of such processing are determined by Union or Member State law, the controller or the specific criteria for its nomination may be provided for by Union or Member State law.

"Processor" means a natural or legal person, public authority, agency or other body which processes personal data on behalf of the controller.

"Recipient" means a natural or legal person, public authority, agency or another body, to which the personal data are disclosed, whether a third party or not. However, public authorities which may receive personal data in the framework of a particular inquiry in accordance with Union or Member State law shall not be regarded as recipients; the processing of those data by those public authorities shall be in compliance with the applicable data protection rules according to the purposes of the processing.

"Third party" means a natural or legal person, public authority, agency or body other than the data subject, controller, processor and persons who, under the direct authority of the controller or processor, are authorized to process personal data.

"Consent" means any freely given, specific, informed and unambiguous indication of the data subject's wishes by which he or she, by a statement or by a clear affirmative action, signifies agreement to the processing of personal data relating to him or her.
 


Types of data processed

We collect and process the following personal data about you:

- meta/communication data (e.g. device information, IP addresses);

Data sources

We receive the data from you (including via the devices you use). If we do not collect the personal data directly from you, we will also inform you of the source from which the personal data originates and, if applicable, whether it originates from publicly accessible sources.

 

Requirement or obligation to provide data

 

Unless expressly stated at the time of collection, the provision of data is not required or mandatory. Such an obligation may arise from legal requirements or contractual regulations.

 

Purposes of data processing

We process your data for the following purposes:

Relevant legal bases

In the following, we inform you of the legal basis of the General Data Protection Regulation (GDPR), on the basis of which we process personal data. Please note that in addition to the provisions of the GDPR, the national data protection regulations in your or our country of residence and domicile may apply. Should more specific legal bases also apply in individual cases, we will inform you of these in the privacy policy.

- Consent (Art. 6 para. 1 sentence 1 lit. a GDPR) - The data subject has given their consent to the processing of their personal data for one or more specific purposes.

- Performance of a contract and pre-contractual inquiries (Art. 6 para. 1 sentence 1 lit. b GDPR) - Processing is necessary for the performance of a contract to which the data subject is party or in order to take steps at the request of the data subject prior to entering into a contract.

- Legal obligation (Art. 6 para. 1 sentence 1 lit. c GDPR) - Processing is necessary for compliance with a legal obligation to which the controller is subject.

- Legitimate interests (Art. 6 para. 1 sentence 1 lit. f GDPR) - Processing is necessary for the purposes of the legitimate interests pursued by the controller or by a third party, except where such interests are overridden by the interests or fundamental rights and freedoms of the data subject which require protection of personal data.

 

Legitimate interests

Insofar as we base the processing of your personal data on legitimate interests within the meaning of Art. 6 para. 1 lit. f GDPR, such interests are
- the improvement of our offer,
- protection against misuse and
- the management of our statistics.

 

Security measures

We take appropriate technical and organizational measures in accordance with the legal requirements, taking into account the state of the art, the costs of implementation and the nature, scope, context and purposes of processing as well as the risk of varying likelihood and severity for the rights and freedoms of natural persons in order to ensure a level of security appropriate to the risk.
The measures include, in particular, ensuring the confidentiality, integrity and availability of data by controlling physical and electronic access to the data as well as the access, input, disclosure, availability and separation of the data. Furthermore, we have established procedures that ensure the exercise of data subject rights, the deletion of data and responses to data threats. Furthermore, we already take the protection of personal data into account during the development and selection of hardware, software and processes in accordance with the principle of data protection, through technology design and through data protection-friendly default settings.

We use SSL encryption to protect your data transmitted via our website. You can recognize such encrypted connections by the prefix https:// in the address bar of your browser.

Data processing in third countries

If we process data in a third country (i.e. outside the European Union (EU), the European Economic Area (EEA)) or if the processing takes place in the context of the use of third-party services or the disclosure or transfer of data to other persons, bodies or companies, this will only take place in accordance with the legal requirements.

Storage duration

We only store your personal data for as long as is necessary to achieve the purpose of the processing or for as long as the storage is subject to a statutory retention period. We store your data,
- if you have consented to the processing, at most until you revoke your consent,
- if we need the data to perform a contract, at most as long as the contractual relationship with you exists or statutory retention periods run,
- if the data is required to fulfil a legal obligation, as long as the legal obligation exists.
- if we use the data on the basis of a legitimate interest, at most as long as your interest in deletion or anonymization does not prevail.


Your rights 

You have the right - in some cases under certain conditions - to request
- free of charge - information about the processing of your data and to receive a copy of your personal data. Among other things, you can request information about the purposes of the processing, the categories of personal data being processed, the recipients of the data (if a transfer takes place), the duration of the storage or the criteria for determining the duration;
- to have your data corrected. If your personal data is incomplete, you have the right to have the data completed, taking into account the purposes of the processing;
- to have your data erased or blocked. Reasons for the existence of a right to erasure/blocking may include the withdrawal of consent on which the processing is based, the data subject's objection to the processing, the unlawful processing of personal data;
- to have the processing restricted;

Use of cookies

Cookies are text files that contain data from websites or domains visited and are stored by a browser on the user's computer. A cookie is primarily used to store information about a user during or after their visit to an online service. The legal basis on which we process your personal data using cookies depends on whether we ask for your consent. If this is the case and you consent to the use of cookies, the legal basis for processing your data is the declared consent. Otherwise, the data processed using cookies will be processed on the basis of our legitimate interests (e.g. in the business operation of our website and its improvement) or, if the use of cookies is necessary to fulfill our contractual obligations and to provide you with our website.

 

Storage duration:

If we do not provide you with explicit information on the storage period of permanent cookies (e.g. as part of a so-called cookie opt-in), please assume that the storage period can be up to two years.

Before we process or have data processed in the context of the use of cookies, we ask users for their consent, which can be revoked at any time. Before consent has not been given, cookies that are absolutely necessary for the operation of our website will be used.

Consent management tool

We use a consent management tool on this website. Our consent management platform collects log file and consent data using JavaScript. This JavaScript makes it possible to inform users about their consent to certain tags on our website and to obtain, manage and document this consent.
The consent ID, which contains the consent data, and the consent status with timestamp are stored in the local memory of your browser and simultaneously on the cloud servers used. Further processing will only take place if you submit a request for information or revoke your consent. In this case, the corresponding information is provided in a compact data format in an easily readable text form for the purpose of data exchange (JSON file).
No user information is stored for the statistics on the use of the consent given or not given. Only the frequency and locations of clicks are stored.
The purpose of data processing is the analysis, management and verification of the consents granted in order to comply with our obligation of GDPR-compliant consent management.
The specific purposes of processing personal data are:
- obtaining and providing consent,
- providing proof of which device you used to give your consent and when, and
- ensuring access to settings and documenting changes.
The legal basis for managing your consent to the processing of your personal data is Art. 6 para. 1 lit. c and f GDPR. Our legitimate interest lies in the legally compliant documentation and verifiability of consents, the control of marketing measures based on the consent given and the optimization of consent rates.
You can revoke the consents you have given yourself. To do this, delete the cookies stored by your browser and call up the page again.
The data is always deleted as soon as it is no longer required. Depending on the cookie, the cookies used have a lifespan of 30 minutes to 2 years. Data relating to revoked consent is stored for a period of three years. This retention period is based, on the one hand, on our accountability obligation pursuant to Art. 5 para. 2 GDPR and, on the other hand, on the statutory limitation periods.

Commercial and business services

We process data of our contractual and business partners, e.g. customers and interested parties (collectively referred to as "contractual partners") in the context of contractual and comparable legal relationships and related measures and in the context of communication with the contractual partners (or pre-contractual), e.g. to answer inquiries or process orders.
We process this data to fulfil our contractual obligations, to secure our rights and for the purposes of the administrative tasks associated with this information and the business organization. We only pass on the data of contractual partners to third parties within the framework of applicable law insofar as this is necessary for the aforementioned purposes or to fulfill legal obligations or with the consent of the persons concerned (e.g. to participating telecommunications, transport and other auxiliary services as well as subcontractors, banks, tax and legal advisors, payment service providers or tax authorities). The contractual partners will be informed about other forms of processing, e.g. for marketing purposes, as part of this privacy policy.
We inform the contractual partners which data is required for the aforementioned purposes before or as part of the data collection, e.g. in online forms, by special marking (e.g. colors) or symbols (e.g. asterisks or similar), or personally.
We delete the data after the expiry of statutory warranty and comparable obligations, i.e, generally after 4 years, unless the data is stored in a customer account, e.g. as long as it must be retained for legal archiving reasons (e.g. for tax purposes, generally 10 years). We delete data disclosed to us by the contractual partner as part of an order in accordance with the specifications of the order, generally after the end of the order.
If we use third-party providers or platforms to provide our services, the terms and conditions and data protection notices of the respective third-party providers or platforms apply in the relationship between the users and the providers.

 

Customer account:

Contractual partners can create an account within our website (e.g. customer or user account, "customer account" for short). If the registration of a customer account is required, contractual partners will be informed of this as well as of the information required for registration. Customer accounts are not public and cannot be indexed by search engines. As part of the registration process and subsequent logins and use of the customer account, we store the IP addresses of the customers together with the access times in order to be able to prove the registration and prevent any misuse of the customer account.
If customers have terminated their customer account, the data relating to the customer account will be deleted, unless their retention is required for legal reasons. It is the customer's responsibility to back up their data when the customer account is terminated.

 

Economic analyses and market research:

For business reasons and in order to be able to identify market trends and the wishes of contractual partners and users, we analyze the data we have on business transactions, contracts, inquiries, etc., whereby the group of data subjects may include contractual partners, interested parties, customers, visitors and users of our website.
The analyses are carried out for the purpose of business evaluations, marketing and market research (e.g. to determine customer groups with different characteristics). If available, we can take into account the profiles of registered users including their details, e.g. on services used. The analyses serve us alone and are not disclosed externally, unless they are anonymous analyses with summarized, i.e. anonymized values. Furthermore, we take the privacy of users into consideration and process the data for analysis purposes as pseudonymously as possible and, where feasible, anonymously (e.g. as summarized data).


Store and e-commerce:

We process the data of our customers to enable you to select, purchase or order the selected products, goods and associated services, as well as their payment and delivery or execution. If necessary for the execution of an order, we use service providers, in particular postal, forwarding and shipping companies, to carry out the delivery or execution for our customers. We use the services of banks and payment service providers to process payment transactions. The required information is marked as such in the context of the order or comparable purchase process and includes the information required for delivery or provision and billing as well as contact information in order to be able to hold any consultations.

Payment service provider

As part of contractual and other legal relationships, due to legal obligations or otherwise on the basis of our legitimate interests, we offer the data subjects efficient and secure payment options and use other payment service providers in addition to banks and credit institutions (collectively "payment service providers").
The data processed by the payment service providers includes inventory data, such as the name and address, bank data, such as account numbers or credit card numbers, passwords, TANs and checksums, as well as the contract, total and recipient-related information. The information is required to carry out the transactions. However, the data entered is only processed by the payment service providers and stored by them. This means that we do not receive any account or credit card-related information, but only information with confirmation or negative information about the payment. Under certain circumstances, the data may be transmitted by the payment service providers to credit agencies. The purpose of this transmission is to check identity and creditworthiness. In order to provide our website securely and efficiently, we use the services of one or more web hosting providers from whose servers (or servers managed by them) the website can be accessed.
